PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR USING THIS WEBSITE, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS WEBSITE.

Rita Monti Free Coffee Machine – Coffee Pods System 

Rita Monti Complimentary Coffee Kit features: one Rita Monti Espresso Coffee Machine, two Rita Monti mugs, one Areolatte, one set of espresso cups and 24 Espresso Biodegradable Coffee pods, for the commercial value of $175.00 (FREE FOR YOU).

Subscribing our favorable Terms and Conditions, you join Rita Monti Biodegradable Coffee Pods System. Your initial charge will be the price of shipping cost only in order to receive the Complimentary Coffee Welcome Kit.

You agree to pay $28.00 every month for one year plus shipping and handling (Flat rate of $6.00), as monthly coffee supply of 24 Espresso Biodegradable Coffee pods. YOU ARE FREE TO STOP MEMBERSHIP AT ANY TIME (see below). 

Stop Membership: You are free to stop the membership at any time (after first 30 days, and for the whole year) simply contacting Rita Monti at info@ritamonti.com, returning the Complementary kit.

In the case that you want to stop the membership, but you want to keep the Complimentary kit, you agree to pay Rita Monti $175.00, as is the value of the kit. In the case that you want to stop the membership returning the Complimentary kit, and if the Complimentary Coffee kit returned is broken, or does not function properly, you agree to pay Rita Monti $175.00, as is the value of the kit.

Renewal: After one year, you will be free to renew the membership, simply contacting Rita Monti at info@ritamonti.com. If you will not decide to renew the membership, you can keep the machine without any charge.

Support: Rita Monti will support you at any time for any issue you have with Rita Monti coffee, Espresso Machine or other Rita Monti products, as described in the Warenty Section.

Exclusive Program Benefits: To make your Rita Monti coffee experience even more exceptional, Rita Monti will award you with special gift after the first 6 months of membership. Gifts depend of availability of Rita Monti Dinnerware Home Collection.

Conditions: You must create a Ritamonti.com account in order to sign up for the Membership. We reserve the right to accept or refuse membership orders at our discretion. Your membership is personal to you, and you may not assign or transfer your membership to any third party and any attempted assignment or transfer will be deemed null and void.

If any problems arise with the shipping address or payment method associated with your membership, we will notify you via email using the address associated with your membership asking that you resolve the problem and reactivate your membership. Your membership may be placed on hold and no additional orders will be processed or shipped until the problem has been resolved and the membership has been reactivated.

Length of Membership: As stated above, your membership will continue until you terminate it by contacting Rita Monti at info@ritamonti.com.  

Modifications: We may in our discretion change these Terms without notice to you.

Termination by Us: We may terminate your membership at our discretion without notice. If we do so, you will only be charged for orders that have been shipped to you.

After Termination by Us:  You are free to cancel or terminate the membership at any time after the first thirty (30) days, after which time Rita Monti will no longer charge your credit card.  To terminate your membership, you must contact Rita Monti at info@ritamonti.com and return the Complimentary Kit in its original condition, ordinary wear and tear excepted, and in its original packaging, which packaging must be undamaged when returned. 

You have three days, after canceling your membership, to determine if you wish to keep the Complimentary Kit and notify Rita Monti if you will be returning the Kit.  You will then have ten (10) days to return the Complimentary Kit.  You hereby authorize and give Rita Monti the right to charge your credit card the FULL $175.00 value if you fail to notify Rita Monti within three (3) days and/or you do not ship the Complimentary Kit within the time provided herein. 

In addition, you hereby authorize and give Rita Monti the right to charge your credit card the FULL $175.00 value if, upon receiving the Complimentary Kit, Rita Monti determines, within its good-faith discretion, that the Complimentary Kit has been damaged and/or is now defective, through no fault of Rita Monti or the manufacturer.  If however, upon receipt, Rita Monti determines that only the original packaging is damaged, you hereby authorize and give us the right to charge your credit card our “packaging fee” equal to $50.00. 

In the event you fail to pay billed charges when due and it becomes necessary for Rita Monti to refer your account(s) to a third party for collection and/or institute collection proceedings against you, you hereby agree that you will be responsible for any and all of Rita Monti’s expenses in seeking payment including, but not limited to, reasonable attorney’s fees, including attorney fees and costs on appeal, and cost of collection.  

Payments and Unpaid Past Due Charges: You must register and pay with one of our accepted credit cards: VISA, Master Card, AMEX, or Discover.

The total cost charged to your credit card for this membership will be $28.00 per month (membership fees and flat shipping and handling fee), plus any applicable sales taxes.

If the credit card associated with your membership account becomes invalid at any time during the membership period or if the charge is otherwise rejected, we will send you an email notifying you that your form of payment failed. Your membership will be placed on hold until you update the payment information associated with your account. Your membership will remain on hold and no additional orders will be processed or shipped until the information is updated and you reactivate your membership.   

You expressly authorize, and specifically consent to allowing, Rita Monti and/or its outside collection agencies, outside counsel, or other agents to contact you in connection with any and all matters relating to unpaid past due charges billed by Rita Monti to you. You agree that, for attempts to collect unpaid past due charges, such contact may be made to any mailing address, telephone number, cellular phone number, e-mail address, or any other electronic address that you have provided, or may in the future provide, to Rita Monti. You agree and acknowledge that any e-mail address or any other electronic address that you provide to Rita Monti is your private address and is not accessible to unauthorized third parties. For attempts to collect unpaid charges, you agree that in addition to individual persons attempting to communicate directly with you, any type of contact described above may be made using, among other methods, pre-recorded or artificial voice messages delivered by an automatic telephone dialing system, pre-set e-mail messages delivered by an automatic e-mailing system, or any other pre-set electronic messages delivered by any other automatic electronic messaging system.

Limited Warranty: Sate USA, Inc. d/b/a Ritamonti.com provides a one-year limited warranty for the Rita Monti Free Coffee Machine.  Please review the terms of the limited warranty and return to us the Warranty Registration Card.

By accepting these Terms, you also agree to read the Espresso Machine’s user manuals and accompanying literature and materials.  Your failure to operate and use the Espresso Machine in compliance with the user manual will result in the Limited Warranty becoming void.

Limitation of Liability: To the maximum extent permitted by applicable law, Sate USA, Inc. and its officers, directors, employees, shareholders or agents shall not be liable for any direct, indirect, punitive or consequential damages, or any other damages of any kind, including but not limited to loss of income, profits, goodwill, data, contracts, use of money, or loss or damage arising from or connected in any way to business interruption, whether in tort (including, without limitation, negligence), contract or otherwise, arising out of or in connection with the use of or inability to use RitaMonti.com or the Membership, the content or the materials contained in or accessed through RitaMonti.com or the Membership, including, without limitation, any damages caused by or resulting from reliance by a user on any information obtained from SATE USA, INC., or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction or unauthorized access to Sate USA, Inc. records, programs or services. In no event shall the aggregate liability of SATE USA, INC. whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, arising out of, or relating to the use of, or inability to use Ritamonti.com or the Membership exceed any compensation you pay, if any, to Sate USA, Inc. for access to or use of Ritamonti.com or the Membership. Some jurisdictions do not allow the limitation of liability in contracts with consumers, so some or all of these limitations of liability may not apply to you.

You agree that any controversy, claim or dispute arising out of or relating to your Membership, the construction, interpretation, performance or breach of the Terms will be determined by arbitration before the American Arbitration Association and its designated Arbitrators. However, to the extent you have in any manner violated or threatened to violate Sate USA, Inc. d/b/a Ritamonti.com intellectual property rights, Sate USA, Inc. d/b/a Ritamonti.com may seek injunctive or other appropriate relief in any state or federal court in Miami-Dade County, Florida, and you consent to exclusive jurisdiction, personal jurisdiction, and venue in such courts. Arbitration under these Terms shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any other court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms will be joined to an arbitration involving any other party subject to these Terms, whether through class arbitration proceedings or otherwise.  The arbitrator shall determine the proportion of the expenses of such arbitration, which each party shall bear; provided, however that each party shall be responsible for its own legal fees.  

Rita Monti.com Terms of Use

These Terms of Use apply to your access to, and use of, all or part of any website or mobile application of Sate USA, Inc. D/B/A Ritamonti.com (“Ritamonti.com”) or its subsidiaries and affiliated companies, and any other site, mobile application or online service where these Terms of Use are posted (collectively, the “Sites”). These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with Ritamonti.com for products, services or otherwise. If you are using the Sites on behalf of any entity, you represent and warrant that you are authorized to accept these Terms of Use on such entity's behalf, and that such entity agrees to indemnify, defend, and hold harmless, you and Ritamonti.com for violations of these Terms of Use. This agreement contains disclaimers and other provisions that limit our liability to you.

If there is any conflict or inconsistency between these Terms of Use and any other terms of use that appear on the Sites, these Terms of Use govern. However, if you navigate away from the Sites to a third party site, you may be subject to alternative terms and conditions of use, as may be specified on such site. In such event, the terms and conditions of use applicable to that site will govern your use of that site.

While we make reasonable efforts to provide accurate and timely information about Ritamonti.com on the Sites, you should not assume that the information is always up to date or that the Sites contain all the relevant information available about Ritamonti.com.

Ritamonti.com reserves the right to change or modify these Terms of Use or any policy or guideline of the Sites, at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to the Sites, and you waive any right you may have to receive specific notice of such changes or modifications. Your continued use of the Sites will confirm your acceptance of such changes or modifications; therefore, you should frequently review these Terms of Use and applicable policies to understand the terms and conditions that apply to your use of our Sites. If you do not agree to the amended terms, you must stop using the Sites.

Eligibility, Registration and Account
The Sites are not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and 18, you may only use the Sites under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.

Please read the Privacy Policy carefully to understand how Ritamonti.com collects, uses and discloses personally identifiable information from its users.

Terms of Sale
All sales from the Sites are governed by Ritamonti.com Terms of Sale. Please refer to our Terms of Sale for the terms, conditions and policies applicable to your purchase of products from Ritamonti.com. By ordering products through our Sites, you agree to be bound by and accept the Terms of Sale. The Terms of Sale are subject to change without prior notice at any time, in Ritamonti.com's sole discretion, so you should review the Terms of Sale each time you make a purchase.

Product Sales and Availability
All products displayed on the Sites will be delivered only within the United States.  All prices for products or offers that are displayed on the Sites are quoted in U.S. Dollars. Ritamonti.com reserves the right without prior notice to discontinue or change specifications on products and services offered on the Sites without incurring any obligations.

The materials and information on the Sites may include technical inaccuracies or typographical errors. The materials, information and services on the Sites are provided “as is” without any conditions, warranties or other terms of any kind. You are granted a limited, non-sub-licensable license to access and use the Sites and Site Materials for personal, informational and shopping purposes only. All other Rita Monti trademarks, service marks, domain names, logos, company names and indicia of origin referred to on the Site are either trademarks, service marks, domain names, logos, company names or indicia of origin or are otherwise the property of Sate USA, Inc. or its affiliates or licensors. In countries where any of the Rita Monti trademarks, service marks, domain names, logos, company names or indicia of origin are not registered, Rita Monti claims other rights associated with unregistered trademarks, service marks, domain names, logos, trade name, company names and indicia of origin. Other product or company names referred to on the Site may be trademarks of their respective owners. You may not use any trademark, service mark, domain name, logo, company name, trade name or indicia of origin of Rita Monti or any third party without written permission from the owner of the applicable trademark, service mark, domain name, logo, company name, trade name or indicia of origin. Ritamonti.com does not control, take responsibility for or assume liability for any User Content posted, stored or uploaded by you or any third party, or for any loss or damage thereto, nor is Ritamonti.com liable for any user conduct or any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter.  You are solely responsible for your use of the Sites and agree to use the interactive areas at your own risk.

If you become aware of User Content that you believe violates these Terms of Use (with the exception of copyright infringement which is addressed in the Digital Millennium Copyright Act Notice section), you may report it by emailing info@ritamonti.com.  Enforcement of these Terms of Use, however, is solely in our discretion and absence of enforcement in some instances does not constitute a waiver of our right to enforce the Terms of Use in other instances. In addition, these Terms of Use do not create any private right of action on the part of any third party or any reasonable expectation or promise that the Sites will not contain any content that is prohibited by these Terms of Use. Although Ritamonti.com has no obligation to screen, edit or monitor any of the User Content posted on the Sites, Ritamonti.com reserves the right, and has absolute discretion, to remove, screen or edit any User Content on the Sites at any time and for any reason without notice. You are solely responsible for creating backup copies and replacing any User Content you post or store on the Sites at your sole cost and expense.

You are hereby granted a limited, non-exclusive right to create text hyperlinks to the Sites for noncommercial purposes, provided such links do not portray Ritamonti.com in a false, misleading, derogatory or otherwise defamatory manner and provided further that the linking site does not contain any obscene, pornographic, sexually explicit or illegal material or any material that is offensive, harassing or otherwise objectionable. This limited right may be revoked at any time. In addition, you may not use Rita Monti's logo or other proprietary graphics to link to our Sites without our express written permission. Further, you may not use, frame or utilize framing techniques to enclose any Rita Monti trademark, logo or other proprietary information, including the images found at the Sites, the content of any text or the layout/design of any page or form contained on a page on the Sites without our express written consent. Applicable Laws and Regulations
By visiting the Ritamonti.com website, you agree that the laws of the state of Florida, without regard to principles of conflict of laws, govern these Terms of Use and any dispute of any sort that might arise between you and Sate USA, Inc. d/b/a Ritamonti.com

Disputes
By visiting the Sate USA, Inc. d/b/a Ritamonti.com website, you agree that any controversy, claim or dispute arising out of or relating to your visit or access to the Ritamonti.com website, the construction, interpretation, performance or breach of this Agreement, including the determination of the scope of this Agreement, shall be determined by arbitration before the American Arbitration Association and its designated Arbitrators. To the fullest extent permitted by applicable law, no arbitration under these Terms of Use shall be joined to an arbitration involving any other party subject to these Terms of Use, whether through class arbitration proceedings or otherwise.  The arbitrator shall determine the proportion of the expenses of such arbitration, which each party shall bear; provided, however that each party shall be responsible for its own legal fees.  

Termination
Notwithstanding any of these Terms of Use, Sate USA, Inc. reserves the right, without notice and in its sole discretion, to terminate your license to use the Sites and to block or prevent your future access to, and use of, the Sites.

Severability
If any provision of these Terms of Use will be deemed unlawful, void or for any reason unenforceable, then that provision will be deemed severable from these Terms of Use and will not affect the validity and enforceability of any remaining provisions.
